Chapter 1 General Provisions

Article 1 (Purpose)

The purpose of these Terms and conditions is to provide for the rights, obligations, responsibilities, and other necessary matters between the members and the Municipal Performance Venue (hereinafter referred to as “Classic Busan”) regarding the terms and procedures for using all services (hereinafter referred to as "Services") provided by Classic Busan.

Article 2 (Definitions of Terms)

The definitions of terms used in these terms and conditions are as follows:

  1. Signing up refers to the act of completing a service use contract by filling out the membership application form provided by Classic Busan and agreeing to these Terms and Conditions.
  2. Member refers to an individual or a corporation who has registered as a member by providing personal information to Classic Busan and has been granted the right to use Classic Busan’s services.
  3. Internet ID refers to a combination of letters and numbers requested by a member and approved by Classic Busan for the purpose of member identification and service usage.
  4. Password refers to a combination of letters and numbers chosen by a member to verify the match with the Internet ID and to protect personal information during communication.
  5. Planned Performance refers to a performance where Classic Busan is the organizer and holds all rights and responsibilities related to the performance. (The same applies to exhibitions.)
  6. Rented Performance refers to a performance where Classic Busan only provides the venue, while the organization or production company renting the venue holds all rights and responsibilities related to the performance. (The same applies to exhibitions.)
  7. Withdrawal refers to the act of terminating the service use contract by a member.
  8. Terms not defined in these Terms and Conditions shall be defined in the separate terms and conditions or regulations for individual services or in accordance with general concepts.
Article 3 (Effectiveness and Amendment of Terms and Conditions)
  1. These Terms and Conditions shall take effect when Classic Busan publishes them on its website or in print, or notifies members by other means.
  2. Classic Busan may amend these Terms and Conditions as necessary, and any amendments will take effect when announced in the same manner as stipulated in Paragraph 1.
  3. Continued use of the services after the effective date of the amended Terms and Conditions shall be deemed as the member’s consent to the changes.
Article 4 (Supplementary Provisions)

Matters not specified in these Terms and Conditions and the interpretation of these Terms and Conditions shall be governed by applicable laws and regulations such as the laws and regulations, guidelines, and standards enacted by the government, and commercial practices.

Chapter 2 Service Use Contract, Membership Benefits, and Usage

Article 5 (Formation of Service Use Contract)
  1. A service use contract shall be established when an applicant completes and submits the designated membership application form via on-line provided by Classic Busan and agrees to these Terms and Conditions.
  2. Classic Busan may cancel the membership registration if the use contract falls under any of the following cases:
    1. If the application is made using another person’s name;
    2. If false information is provided in the application form;
    3. If the application is made with the intent to disrupt social order or public morals;
    4. If the applicant interferes with another person’s use of Classic Busan’s services or misuses their information;
    5. If the website is used to defame or slander other persons;
    6. If the website is used for activities prohibited by the laws and regulations or these Terms and Conditions;
    7. If the application is contrary to the policy direction pursued by Classic Busan; or
    8. If the application does not meet other membership requirements set by Classic Busan.
  3. Classic Busan may postpone the formation of the service use contract until the cause is resolved in any of the following cases:
    1. If there is a shortage of service-related resources;
    2. If there is any technical disruption;
    3. If it is unavoidable for urgent inspection and expansion of the system or repair of the replaced equipment; or
    4. If any other reason that services cannot be provided such as overload of service usage has occurred.
Article 6 (Consent to Use of Member Information)
  1. Classic Busan collects only the minimum necessary information in the following cases:
    1. Information provided by the members during sign-up
    2. Information provided by the members for community utilization
    3. Information provided by the members for participation in various events
    4. Information provided by the member for advertisements or prize acquisition
  2. Classic Busan will not disclose or distribute members’ information to third parties without their consent, except in the following cases:
    1. Where the minimum necessary information is provided to a ticket sales agency designated by Classic Busan for ticket reservations, etc.
    2. Where it is required by any national agency pursuant to the provisions of the relevant laws
    3. Where it is necessary for criminal investigations or there is a request from any relevant agency
  3. By applying for service use under these Terms and Conditions, the member is deemed to have consented to the collection, use, and provision of their information as specified in the application.
Article 7 (Membership Registration and Sign-up for Individuals Under 14 Years Old)
  1. Individuals under the age of 14 must obtain the consent of their legal guardian to sign up as a member. Classic Busan may refuse a sign-up for membership if such consent is not obtained.
  2. Classic Busan will process refunds according to the annual membership fee refund policy if a legal guardian requests the withdrawal of a paid membership registration for a member under the age of 14 who has not obtained the guardian’s consent.
Article 8 (Modification of Registered Information)
  1. If there are any changes to the information provided at the time of application, the member must update it online or request Classic Busan to make the necessary corrections.
  2. Classic Busan is not responsible for any damages resulting from the member’s failure to update their information.
Article 9 (User Information Security)
  1. From the moment an applicant completes the membership registration process, the member is responsible for maintaining the confidentiality of their provided information. The member is solely responsible for all consequences arising from the use of their Internet ID and password.
  2. Members are fully responsible for managing their Internet ID and password, and if the member discovers any unauthorized use of their ID or password, he/she must immediately report it to Classic Busan. Failure to do so makes the member solely responsible for any resulting consequences.
  3. Members must properly log out after using Classic Busan’s services. Classic Busan is not responsible for any damages or losses resulting from third-party access to the member’s information due to improper log-out.
  4. Members should be aware that personal information voluntarily provided online may be collected and used by others. The member is responsible for maintaining the confidentiality of their personal information, and Classic Busan assumes no liability for any consequences arising from the leakage of such information.
Article 10 (Service Hours)
  1. The service is in principle available 24 hours a day, 365 days a year, unless there are special technical or operational issues.
  2. However, exceptions apply on specific dates or times designated by Classic Busan for regular maintenance or other necessary inspections.
Article 11 (Change and Termination of Service)
  1. Classic Busan is not responsible for any expected gains or losses from using the service or for any damages resulting from the data obtained through the service. Additionally, Classic Busan does not guarantee the reliability, accuracy, or content of information, data, or facts posted by members.
  2. Classic Busan is not liable for any damages incurred by members due to their own intentional misconduct or negligence while using the service.
Article 12 (Copyright of Posts)
  1. The copyright of posts posted by members within the service belongs to the respective members. However, Classic Busan may use the posts for publication or distribution in other services.
  2. Members are fully responsible for any civil or criminal liability arising from the infringement of third-party copyrights through their posts.
  3. Members may not process, sell, or use for commercial purposes any information obtained through the service.
Article 13 (Deletion of Posts or Contents)
  1. Classic Busan may delete any content posted or registered by members without prior notice if it is deemed to fall under any of the following categories, and Classic Busan assumes no liability for such deletions:
    1. Where the content infringes on the rights of others, such as invasion of privacy or defamation.
    2. Where the contents violate public order or social morals.
    3. Where the contents are deemed to be associated with criminal activities.
    4. Where the content infringe on copyrights or other rights of third parties.
    5. Where the contents violate any relevant legislation or regulations set by Classic Busan.
    6. When the content violates these terms, or is deemed commercial, illegal, obscene, or vulgar.
  2. The Busan City Government reserves the right to edit or relocate posted content three days after providing prior notice.
  3. If posted content loses its effectiveness over time or its purpose becomes unclear, the Busan City Government may delete it after a one-week notification period following a public announcement.
Article 14 (Membership Types and Fees)
  1. Members are classified into general members and venue reservation system members based on the scope of their system usage.
  2. General Members are those who can access all services provided by Classic Busan, except for venue reservations.
    1. General members are divided into individual members and corporate members, and individual members are further divided into free members and paid members.
    2. Free members do not pay any fees and receive benefits designated by Classic Busan.
    3. Paid members pay a designated annual membership fee (KRW 50,000. KRW 100,000, or KRW 1,000,000) and receive benefits determined by Classic Busan based on the amount paid.
    4. Corporate members pay a designated annual membership fee (KRW 2,000,000) and receive benefits determined by Classic Busan.
  3. Venue Reservation System Members are individual or corporate members who use the venue reservation system for booking purposes.
  4. Sponsoring Members are individuals who provide their personal information, register as members, and contribute donations to receive honorary services provided by the venue.
Article 15 (Services for General Members)
  1. Classic Busan provides the following benefits to its members:
    1. Provision of performance information via E-mail/SMS (if consent is given)
    2. Opportunity to participate in website events
    3. Waiver of booking fees for reservations made through the Classic Busan website, on-site, or by phone
    4. Waiver of booking fees for reservations made through the Classic Busan website, on-site, or by phone
    5. Benefits provided to each membership type are as follows:

Article 16 (Cancellation and Refund Policy for Ticket Purchases)
  1. Paid members are not charged a booking fee when using Classic Busan’s sales channels (website, mobile, on-site box office, customer service center).
  2. When paid members cancel or change their seat, the following refund policy applies based on the Consumer Dispute Resolution Guidelines set by the Fair Trade Commission:
    1. Until 10 days before the performance: Full refund
    2. From 9 days to 1 day before the performance: Refund after a 10% deduction
      However, if canceled on the day of booking and up to 3 days before the performance, a full refund will be given.
    3. On the day of the performance: Refund after a 90% deduction
      However, for planned performances, a refund can be made until the performance starts. For venue-rented performances, the refund policy of the organizing group applies. Additionally, customers who use the sales channels of ticket agencies may be subject to the agency’s policy.
Article 17 (Withdrawal from Membership and Loss of Eligibility)
  1. A member may request withdrawal at any time, and Classic Busan will process the withdrawal immediately, except for the following cases:
    1. If there is any reason to specifically refuse a member’s withdrawal according to the relevant legislation
    2. If a paid member or corporate member requests withdrawal, Classic Busan will process the refund according to the refund policy and then proceed with the withdrawal. However, if the member wishes to continue receiving paid services, withdrawal cannot be processed.
    3. If a member using services such as Academy courses requests withdrawal, Classic Busan will process the service fees according to the refund policy and then proceed with the withdrawal. However, if the member wishes to continue using the service, withdrawal cannot be processed.
    4. If a member withdraws, Classic Busan will immediately delete the member's personal information, and once deleted, the member cannot request recovery of the information.
  2. Even if a member withdraws according to paragraph 1, if there is a need to retain transaction information in accordance with the relevant legislation, Classic Busan may retain the personal information for the period specified in its Personal Information Processing Policy. This information can be accessed by the member, but corrections or deletions cannot be requested.
  3. If a member falls under any of the following conditions, Classic Busan may terminate the service agreement or restrict the use of services without prior notice:
    1. Where false information was registered during the application process
    2. Where the member is involved in criminal activities
    3. Where the member has illegally used another person's internet ID and password
    4. Where the member intentionally obstructed the operation of the service
    5. Where the same member has registered multiple accounts under different IDs
    6. Where the member has distributed content that violates public order or morality
    7. Where the member has damaged another person’s reputation or caused harm
    8. Where the member has engaged in fraudulent, false, or abusive practices in ticket purchases, events, or other applications
    9. Where the member has used or abused the membership card in an unauthorized or illegal manner

Chapter 3 Obligations and Responsibilities

Article 18 (Obligations of Classic Busan)
  1. Classic Busan shall not engage in any acts prohibited by laws and these Terms and Conditions or contrary to public morals, and shall strive to provide continuous and stable services.
  2. Unless there are special circumstances, Classic Busan shall ensure that members can use the requested services from the designated service commencement date.
  3. If a member raises an issue of inconvenience or complaint that is deemed legitimate, Classic Busan shall address it in accordance with the established standards.
  4. Classic Busan shall not be held responsible for any service disruptions caused by the member’s fault.
Article 19 (Obligations of Members)
  1. Members must accurately enter the required information when signing up. In addition, they must maintain and update their provided information to ensure its accuracy, and members shall not allow third parties to use their internet ID and password.
  2. Members shall not engage in any commercial activities using the services without prior approval from Classic Busan.
  3. Members shall not copy, reproduce, modify, translate, publish, broadcast, or otherwise use the information obtained through Classic Busan's services, nor provide it to others, without prior approval from Classic Busan.
  4. Members are responsible for managing their membership card and membership number. They bear full responsibility for any consequences resulting from negligence in management or unauthorized use.
  5. Members shall not transfer, gift, or provide as security their membership card and membership number to third parties.
  6. If a member's membership card or membership number is used fraudulently, the member shall promptly notify Classic Busan thereof.
  7. Members shall not engage in any of the following acts in relation to the use of Classic Busan services:
    1. Fraudulently using another member's internet ID
    2. Engaging in criminal activities or acts related to criminal activities
    3. Acts harming good morals or disrupting public order
    4. Defaming or insulting others
    5. Infringing on the intellectual property rights or other rights of others
    6. Engaging in hacking activities or spreading computer viruses
    7. Continuously sending unsolicited advertisements or other specified content against the recipient's will
    8. Any act that disrupts or is likely to disrupt the stable operation of the service
    9. Any other acts that violate applicable laws.
Article 20 (Ownership of Classic Busan)
  1. Classic Busan has the ownership of the intellectual property rights and other related rights of the services provided by Classic Busan, including the necessary software, images, marks, logos, designs, service names, information, and trademarks.
  2. Except as explicitly authorized by Classic Busan, you may not modify, lease, lend, sell, distribute, create, transfer, sublicense, establish security interests, or commercially exploit all or part of the assets specified in Paragraph 1, nor may you permit any third party to engage in such acts.
Article 21 (Compensation for Damages)

Classic Busan shall not be liable for any damages incurred by members in connection with services provided free of charge, except in cases where Classic Busan has committed an intentional criminal act.

Article 22 (Disclaimer)
  1. Classic Busan is not obligated to guarantee or represent any opinions or information expressed in the service and does not approve, oppose, or modify opinions expressed by members or third parties. In any case, Classic Busan shall not be liable for any loss of profits or damages incurred by members by relying on the information contained in the service.
  2. Classic Busan assumes no responsibility for any transactions such as merchandise transactions or financial transactions conducted between members or between a member and a third party through the service. In addition, Classic Busan is not liable for any benefits expected by members in relation to using the service.
Article 23 (Competent Court)

If a lawsuit has been filed for the dispute arising out of or in relation to the use of this service, the court with exclusive jurisdiction shall be the court governing the seat of Classic Busan’s principal office.

Addendum

These Terms and Conditions shall take effect on Jan. 1, 2024.
